What is Hypothecation in a Car? : Simply Explained

If you bought your car on loan, you've probably seen the word "hypothecation" printed on your RC. Here's what it actually means, in plain terms.

The simple explanation

When a bank finances your car, it doesn't just hand over the money and walk away. It gets a legal claim on the vehicle until the loan is repaid — that claim is called hypothecation. Your RTO records this by adding the bank's name to your car's RC as the financier.

Basically, until your loan is closed, the car isn't fully "yours" on paper. The bank has a say in it.

Why it matters

While you're still repaying the loan, hypothecation protects the bank — if you default, they can legally repossess the vehicle. That's normal and expected.

The part people miss is what happens after the loan is closed. Repaying your last EMI doesn't automatically remove hypothecation from your RC. You still have to apply separately for hypothecation termination at your RTO to get the bank's name taken off. Until you do:

  • You can't sell or transfer the vehicle without the bank's consent

  • Insurance claims get more complicated

  • Buyers will discount your resale price for the pending paperwork

What you need to remove it

Once your loan is paid off, get the bank's NOC (loan closure letter) and signed Form 35, then apply at your RTO to have the hypothecation entry removed via the Parivahan portal. Once approved, you get a fresh RC showing you as the sole, unencumbered owner.
